Comments of Matra Marconi Space (United Kingdom)
on the Memorandum of Understanding

Articles 1, 2 and 3 address issues of user terminals related to:

- Type approval.

- Licensing.

- Marking of terminals.

Assignment of frequencies to user terminals is important for facilitating the licensing regime and the free circulation of user terminals. This is an issue which has not been included in the MoU. Participants from Matra Marconi Space under the sector membership of Matra Communications, therefore, recommend the following additional article.

Article XX Frequency Assignment to Terminals

The Parties shall agree on the frequency assignment to user terminals of a specific system recognizing that the common frequency allocation for the specific system would minimize operational constraints and cost implications on GMPCS terminals.

In Article 2 of the draft MoU, "... class licences or blanket approvals" of user terminals are recognized and provided for in the MoU. The article is silent as far as the individual licence is concerned. In order to exempt the individual licence, the participants of Matra Marconi Space under the sector membership of Matra Communications recommend the addition of the words "and terminals shall be exempted for requiring an individual licence" after the word recognized. The modified Article 2 is rewritten as follows:

Article 2 Licensing of Terminals

The Parties shall develop ... or blanket approvals). That such ... mutually recognized and terminals shall be exempted for requiring an individual licence.

In order to link Principle 7 of Opinion 2 with the draft MoU, the following modifications to Article 3 are recommended:

Article 3 Marking of Terminals

The Parties shall develop ... and licensing on the basis of standards specific to each system and such other relevant standards for facilitating the transborder use of terminals.
