14-15 October 2013, Asia-Pacific Regulators’ Roundtable  

The International Telecommunication Union (ITU) and the the Korea Communications Commission (KCC), organised ITU-KCC Asia-Pacific Regulators’ Roundtable and the ITU-KCC International Training Program (ITP) 2013. The events were jointly organized by ITU and KCC, with support from the Department of Broadband, Communications and the Digital Economy (DBCDE), Government of Australia and will be held from 14 to 18 October 2013 at Hotel Ritz Carlton, Seoul, Republic of Korea.

The 3rd ITU Asia-Pacific Regulators’ Roundtable (14-15 October 2013) aimed to hold strategic discussion and information sharing amongst senior management of telecommunication, broadcasting and converged ICT regulators in the area of protecting consumers in the digital age. The objective of the meeting was to share real experiences, brainstorm on possible solutions to address emerging challenges and discuss potential collaboration. The Regulators’ Roundtable was open for participation from representatives of policy making and regulatory agencies only.

The ITU-KCC International Training Program 2013 (16-18 October 2013) aimed at building skills on the policy and regulatory enablers for realizing a smart society powered by the Information and Communication Technologies (ICT). The training highlighted the building blocks of the enabling environment required to embrace convergence and realize a smart society. It brought together international experiences in this area with focus on Republic of Korea’s experience and lessons learnt.

10:00 - 12:00 SESSION 1: CONSUMER PROTECTION IN THE DIGITAL ERA - SETTING THE CONTEXT AND IDENTIFYING THE ROLE OF TELECOMMUNICATION/BROADCASTING/CONVERGED ICT REGULATORS
 
  Session Chair: Mr. Dae-Hee Kim, Standing Commissioner, Korea Communications Commission, Republic of Korea
 
  Objective: This session seeks to discuss how consumer protection frameworks have changed from voice & data environment to telecommunications/ICT applications environment and the current issues for the regulators. ICT application users today, engage with national & international stakeholders from multiple sectors including ICT, Broadcasting, Banking, Health, Security, Law Making and Enforcing amongst others and are hence vulnerable to new and complex problems that did not occur in the voice and data environment. It requires policy, regulatory and cooperation frameworks not only amongst telecommunication consumer protection agencies (e.g. regulators, ombudsmen, consumer courts) but also multi-sector consumer protection and redressal agencies from other sectors. An important step in this context is identifying roles and responsibilities of the telecommunication regulator in this new environment.

13:30 - 15:00 SESSION 2: BROADBAND ACCESS SERVICES: PROTECTING CONSUMERS IN A COMPETITIVE ENVIRONMENT
 
  Session Chair: Mr. Leong Keng Thai, Director General (Telecoms and Post), Infocomm Development Authority, Singapore
 
  Objective: This session aims to brainstorm on consumer protection measures for broadband access services including quality of service and experience, net neutrality and security, competition issues, service bundling and tariff packages, and roaming. Such issues have raised new challenges for regulators. In this context, the session will examine a combination of measures (e.g. competition, guidelines, code of conduct, agreements, standards, regulations, monitoring, enforcement etc.) that could be employed to stimulate the roll out of new services and applications for consumers in an efficient manner while encouraging competition.

15:30 - 17:00 SESSION 3: TELECOMMUNICATION AND BROADCASTING SERVICES OVER COMMON PLATFORMS- NEED FOR REGULATORY COOPERATION TO ENSURE EFFECTIVE PROTECTION OF CONSUMERS

  Objective: Consumers are increasingly accessing telecommunication and broadcasting services unaware of the platform being used. Traditionally, the consumer protection frameworks for the two sectors have been designed and regulated differently. However, with convergence, it is becoming increasingly difficult to distinguish amongst the online services delivered by licensees/ carriers/ operators that are governed under the two regimes. While some of the countries in Asia-Pacific region have converged telecommunication and broadcasting regulators, separate regulatory authorities for the two sectors is still the norm. This session will deal with regulatory issues that require close cooperation amongst telecommunication and broadcasting regulators in view of protecting consumers.

09:30 - 11:30 SESSION 4: ICT APPLICATIONS POWERING THE DIGITAL SOCIETY – PROTECTING CONSUMERS (CITIZENS)
 
  Session Chair: Mr. Chris Chapman, Chairman and Chief Executive, Australian Communications and Media Authority
 
  Objective: In today’s world of ICT applications and social media, consumers are accessing services provided by third parties from around the world using ICT devices and telecommunication/ broadcasting service provider networks. These services (e.g. Broadcasting, e/m-Government, e/m- Health, m-Banking, Social media, e/m-Commerce, and cloud services) are offered as part of telecommunication service providers’ service package, over the top content services or through direct contract between the consumers and independent national/ international public and private enterprises. Often in these circumstances, the consumer (in some cases citizens at large) is exposed to enhanced financial, privacy and security risks without enough awareness or knowledge. In several cases, the redressal mechanisms require coordination across frameworks governed by multiple regulators (national and international) in a varying policy, regulatory, commercial and legislative environment. In addition, the unavailability of simplified mechanisms for taking up the concerns, the lack of advice on clear direction on the process and low level of consumer awareness are critical concerns. This session will discuss the possible regulatory approaches that can be taken by the telecommunication, broadcasting and converged ICT regulators while identifying concrete steps to inform, educate, protect and ensure redress for consumers.
