This Recommendation defines a framework on the use of market surveillance to combat counterfeit Telecommunications/ICT equipment.
ITU-T Recommendation Q.5050 (Framework for solutions to combat counterfeit ICT devices) points to product certification associated with market surveillance as one of the possible approaches to eliminating counterfeit devices.
Q.5050 highlights that market surveillance is vital to the smooth functioning of the telecommunications market, and it is essential to protect consumers and workers from the risks posed by non-compliant products. In addition, market surveillance helps to protect responsible companies from unfair competition by unscrupulous economic operators who ignore the rules or cut corners.
Q.5050 presents that the establishment of an robust conformity assessment scheme (CAS) is required to efficiently deploy a centralized national reference database of authorized equipment, based on type approval, and that the use of CAS deployment can assist on the construction of a national reference database of authorized equipment to be able to identify counterfeit products through the imposition of market surveillance and other enforcement measures.
Q.5050 also indicates that visual inspection may not be enough to differentiate a genuine device and further technical expertise or laboratory tests could be required.
EC Regulation No. 765/2008 defines market surveillance as: activities and measures carried out by designated authorities to ensure that products comply with the requirements set out in the relevant legislation and do not endanger health, safety or any other aspect of public interest protection. It is therefore recommended that the administration responsible for assessing product conformity establishes a market surveillance program to assist in the identification of counterfeit products and ensure that only products approved or certified by the administration be sold to the end user.
The proposed Recommendation in the Annex establishes a methodology to assist administrations in implementing their Product Market Surveillance Program for combat counterfeit and tampered Telecommunications/ICT equipment.
