This contribution examines requirements for satellite operators to establish physical gateway earth stations in each country where services are provided. It highlights how technological developments now allow legitimate regulatory objectives, including lawful interception, security and data protection, to be met through alternative technical solutions. The paper therefore encourages flexible, technology-inclusive regulation that avoids unnecessary infrastructure requirements.
