The UAE Federal Public Private Partnership Framework

Description

The UAE Federal Public-Private Partnership Framework represents a comprehensive federal framework and a defined federal end to end PPP operating model designed to regulate and enable strategic collaboration between federal government entities and private sector partners. The framework combines the legal foundation provided by the PPP Law with structured implementation guidance through supporting policies, toolkits, governance procedures, and operational manuals issued by the Ministry of Finance.

Together, the PPP Law and its implementation framework acts as an one stop destination which provides a ready reference of the complete lifecycle model for public–private partnerships, covering project identification, feasibility assessment, procurement, contract structuring, financial close, implementation, and long-term performance monitoring. The framework introduces defined principles for project selection and appraisal, standardized governance structures, transparent procurement procedures, and risk allocation mechanisms that ensure accountability, efficiency, and value for money across government projects.

By establishing a predictable regulatory and institutional environment, the PPP framework provides a stable ecosystem which enables federal entities to mobilize private sector investment, innovation, and technical and operational expertise in the development and operation of public infrastructure and services. This approach supports economic diversification, strengthens investor confidence, and enhances the delivery of strategic national projects while maintaining government oversight and safeguarding public interest.

Replicability

The UAE PPP framework is highly replicable because it combines a formal legal structure with standardized operational guidance, enabling government entities to implement partnerships using a consistent and transparent process.
The framework includes:
• Federal Decree-Law No. 12 of 2023, which establishes the legal foundation for PPP projects.
• Manual on PPP Projects, management and execution issued in June 2024.

The framework details the following:
• PPP governance procedures and implementation manuals, which provide practical guidance for project development, procurement, contract management, and performance monitoring.
• Standardized project lifecycle processes, including feasibility assessment, value-for-money analysis, competitive tendering, and risk allocation.
• Because the framework clearly defines institutional roles, procurement procedures, and contract structures, it can be replicated across multiple sectors such as infrastructure, healthcare, education, transport, and digital services.
• The framework is sector-agnostic and its replicability allows for its scalable adoption for implementation across all sectors.

The Federal PPP regulatory framework complements the local emirate framework (each emirate has a separate regulatory framework) thereby harmonizing and providing flexibility in executing the projects.
Specific examples of the local emirate PPP regulatory framework is as mentioned below:
• Dubai Law No. 22 of 2015 on Public-Private Partnerships
• Public-Private Partnership Guidelines as issued by Department of Finance (Dubai), First Edition 2019.
• Abu Dhabi Law No. 2 of 2019 on Public-Private Partnerships
• Ajman Law No. 1 of 2022 on Public-Private Partnerships

Sustainability

The PPP framework, supported by implementation law, manual and governance procedures issued by the Ministry of Finance, provides a robust foundation for ensuring the long‑term sustainable implementation of public infrastructure and service delivery. Through clear guidelines on project structuring, risk allocation, partnership governance, and financial oversight, the framework enhances efficiency, transparency, and resilience in the development and management of federal projects. The framework promotes sustainability through four key mechanisms:
Financial Sustainability
• The PPP model enables governments to leverage private sector financing, reducing reliance on public budgets while ensuring efficient allocation of public resources.
Institutional Sustainability
• The framework provides standardized procedures for project preparation, procurement, and contract management, ensuring consistent governance and accountability across federal entities.
Operational Sustainability
• PPP contracts incorporate performance-based monitoring mechanisms and long-term concession structures that ensure service quality and operational efficiency throughout the project lifecycle.
Economic and Social Sustainability
• By enabling investment in sectors such as infrastructure, energy, healthcare, and digital services, the PPP framework contributes to sustainable economic development and improved public services.

Through this integrated legal, institutional, and operational framework, the PPP model provides a scalable mechanism for long-term national development while encouraging responsible private sector participation.

WSIS values promotion

The UAE PPP framework supports the objectives of the World Summit on the Information Society (WSIS), particularly Action Line C6 – Enabling Environment, by establishing a comprehensive regulatory and governance structure that facilitates collaboration between public institutions and private sector partners. The framework contributes to the WSIS enabling environment through: • Clear regulatory foundations established by Federal Decree-Law No. 12 of 2023 • Standardized project development and procurement procedures outlined in PPP implementation manuals • Transparent governance structures that promote accountability and investor confidence • Multi-stakeholder collaboration between government entities, investors, financial institutions and end-users. By creating a stable investment environment, the PPP framework enables private sector participation in projects related to federal infrastructure and technology-enabled public solutions (if applicable) supporting digital transformation initiatives across the UAE. The inherent structure of the PPP incentivizes the private sector to introduce efficiency through technological innovations/digital infrastructure in the project.
