Conditions for the Use of Software

The present conditions of use of software ("Terms and Conditions") govern the use 
of AP7Capture (the "Software") which has been developed by the International 
Telecommunication Union (the "ITU"). By using the Software, you unreservedly agree 
to be bound by the present Terms and Conditions. ITU reserves the right to make 
changes to these Terms and Conditions at any time. You will be subject to the 
Terms and Conditions in force at the time you use the Software.

Grant of License

ITU hereby grants you, and you accept, a limited, non-exclusive, non-transferable 
worldwide right and license to: 
a.  In case the Software is a software application: to install, load, transfer, 
and run the Software on a computer you control, solely for personal or internal 
business; Or
b.  In case the Software is a software library: to install, link to and use the 
Software in a software developed by you solely for personal use or for internal 
business purposes
  
You are not permitted to sell, rent, lease, sub-license, loan, copy, modify, 
adapt, merge, translate, reverse engineer, decompile or create derivative works 
based on the whole or any part of the Software or its associated documentation or 
use. You shall not use or permit the Software to be used to perform services for 
third parties, without the prior written authorization of ITU, and shall not 
disclose, provide or otherwise distribute or make available the Software or parts 
thereof, individually or as part of another software, in any form to any third 
party, without the prior written consent of ITU.  

Termination

ITU reserves the right to terminate the license, at no cost for ITU, if you fail 
to abide by these Terms and Conditions, as per above (in such a case, ITU shall 
inform you of such termination). In the event of such termination, you must erase, 
uninstall and refrain from making any use of the Software.

Ownership of Software

You acknowledge that the Software -including all enhancements, corrections and 
modifications thereto- all copyrights, patents, trade secrets, or trademarks or 
other intellectual property rights protecting or pertaining to any aspect of the 
Software and any associated documentation is, are and shall remain the sole and 
exclusive property of ITU and, where applicable,  ITU’s suppliers.  These Terms 
and Conditions do not convey title or ownership to you, but instead grant you the 
limited rights set forth above. ITU reserves all rights not expressly granted by 
these Terms and Conditions. 

No product maintenance and support
----------------------------------------------------------------------------------
You are not entitled to any maintenance or support for the Software or any 
upgrades or enhancements under these Terms and Conditions. ITU may offer automatic 
or manual updates to the Software at any time and without specific notice.

Warranties
----------------------------------------------------------------------------------
The Software along with any accompanying documentation is provided "as is" without 
warranties of any kind. ITU does not warrant, guarantee or make any 
representations (implied or expressed) regarding the use, or the results of use, 
of the Software, in terms of correctness, accuracy, adequacy, reliability, 
merchantability or fitness for a particular purpose. ITU expressly disclaims any 
liability for errors or omissions in the content of the Software, and shall not be
held liable for any direct, indirect, consequential or incidental damages arising
out of the use of or inability to use the Software.

Privileges and Immunities of ITU

None of the provisions of these general conditions of sale shall be interpreted as 
constituting a derogation or renunciation of the privileges, immunities and 
facilities enjoyed by ITU in accordance with the international agreements and 
national laws applicable to it, including the Headquarters Agreement concluded 
with the Swiss Federal Council on 22 July 1971.
