Summary: As ITU-T SG3 has rightly noted in the past, market competitiveness is fundamental to the broader policy goals of service access and affordability. As such many regulatory authorities backed by competition mandates in parent laws have embarked on market definitions and SMP assessments in an effort to identify market failures and competition abuses. The SSNIP and Structure - Conduct - Performance (SCP) conceptual methodologies have been widely adopted as analytical frameworks in the identification of market power. Indeed there are limited alternatives that may provide the requisite evidential standard in the determination of SMP. In practice however, while the structural assessments in SCP analyses may identify domestic barriers to entry and expansion that concur upon certain actors privileged market positions, the domestic market assessments may not fully identify the market power of players that is resulting from multinational presence.
