Title of Presentation: Legal and Liability Issues of Telematics

The legal issues involved with market introduction of Telematic Systems in automobiles are diverse. First of all, issues of liability of the driver using such systems arise as well as potential product liability claims which can cause financial damage but even more damage to reputation. Car manufacturers and many other parties involved, such as device manufacturers, software providers, data providers and infrastructure providers are faced with many issues they have not experienced before when dealing with their core business.

This includes the question of who out of all players is liable for which event or if any liability can be excluded e.g. on a contractual basis. From a governmental standpoint also issues of traffic safety and data protection arise. The specific questions arising out of all these issues shall be presented. Furthermore, it shall be explained that there are already attempts in the industry of driver assistance systems to form a consensus between all stakeholders to overcome especially liability concerns. This shall serve as a basis for discussion whether such cooperation is also feasible for the Telematics market.
