On 7th of May
2010 the Polish Parliament passed the Act on supporting the
development of telecommunication services and networks. The
purpose of the act was to achieve the proper legal basis for the
universal access to telecommunication services thought new
technologies and with the main focus on the broadband access.
The introduced and analyzed act includes solutions concerning
the efficient investment in telecommunication infrastructure by
ensuring at the some time the proper level of the competition on
the market.
This case
study aimes at developing a good understanding on regulations introduced by Polish Government in regards to the
development of the broadband infrastructure, while providing the
answers to the following questions.
How the investments in the broadband
infrastructure are supported at the national level?
What rules apply for the local authorities
to be able to perform the telecommunication services?
What rules apply to access the
telecommunication infrastructure or other infrastructure which
was build from the public sources?
What are the rights and obligations for
investors and owners in terms of property access for the purpose
of providing telecommunications services?
What rules apply for setting up the
regional broadband networks or other telecommunication
infrastructure?
Results of the
case study has been presented in five parts as follows:
